These Terms of Service (the "Terms") govern your access to and use of https://dloria.com and any related services provided by Dloria, Inc. (collectively, the "Services"). Throughout these Terms, "Dloria," "we," "us," and "our" refer to Dloria, Inc. "You" and "your" refer to the person accessing or using the Services.

Our online store is hosted by Shopify, which provides the commerce platform that allows us to offer products and Services to you.

By visiting the Site, creating an account, submitting information, or purchasing a product, you agree to these Terms and to any policies referenced in them, including our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree, do not use the Services.

Eligibility and Use of the Services

You must be at least the age of majority in your state or country of residence to make a purchase through the Site. If you permit a minor to use a device you control, you are responsible for the minor's activity on the Services.

You may use the Services only for lawful, personal, and noncommercial purposes unless we have authorized another use in writing. You may not use our products or Services for any illegal or unauthorized purpose or violate any applicable law.

Accounts

You may be able to create a customer account. You are responsible for providing accurate and current information, protecting your login credentials, and all activity conducted through your account.

Notify us promptly at info@dloria.com if you believe your account has been accessed without authorization. We may suspend or terminate an account when reasonably necessary to protect you, Dloria, or others; investigate suspected fraud or misuse; or comply with law.

Product Information

We make reasonable efforts to display product descriptions, dimensions, materials, colors, stone sizes, images, and other details accurately. However:

Colors and appearance may vary depending on lighting, photography, screen settings, and the individual characteristics of an item.
Measurements and weights are approximate unless expressly stated otherwise.
Packaging may change without notice.
Minor variations that do not materially affect the item's appearance or function may occur.

Product images are for illustration and may not show an item at its exact size. Please review all product details before purchasing. If the item you receive is materially different from its description, contact us promptly so we can evaluate the issue under our Return and Refund Policy.

Pricing and Availability

Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes, shipping costs, and other charges will be shown at checkout when required.

Prices, promotions, availability, and product assortments may change without notice. A price or promotion offered on Dloria.com may differ from a price or promotion offered by Macy's, Nordstrom, or another retail partner. We do not guarantee price matching between sales channels.

We try to keep product and pricing information accurate, but errors may occur. If we discover a material pricing, product, or availability error after you place an order, we may contact you for instructions or cancel the affected item and issue a refund. We will not substitute a materially different product without your consent.

Orders and Order Acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges that we received your order but does not necessarily mean that we have accepted it. We may accept or decline an order in our reasonable discretion, including because of product availability, payment authorization, suspected fraud, pricing or listing errors, shipping restrictions, or suspected unauthorized resale.

We may limit or cancel quantities purchased per person, household, account, payment method, billing address, or shipping address. If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method.

Once an order enters fulfillment, we may be unable to change or cancel it. Contact us as soon as possible if you need assistance.

Payments

You agree to provide current, complete, and accurate billing and payment information. You represent that you are authorized to use the payment method submitted with your order.

Payment services are provided by third-party processors. Your use of a third-party payment option may also be governed by that provider's terms and privacy policy. We may use reasonable fraud-prevention measures and may request additional information to verify an order.

Shipping and Delivery

Shipping and delivery estimates are estimates and are not guaranteed unless we expressly state otherwise. Delivery may be affected by carrier delays, weather, holidays, address errors, security reviews, or events outside our reasonable control.

We will ship orders within the time stated at checkout or in the applicable Shipping Policy. If we cannot ship within the promised time, we will provide any notice, cancellation option, or refund required by applicable law.

You are responsible for providing a complete and accurate delivery address. Additional charges resulting from an incorrect or incomplete address may be your responsibility where permitted by law.

Risk of loss passes to you when the order is delivered to the address provided, except where applicable law requires otherwise. If tracking shows a package as delivered but you cannot locate it, or if an order arrives damaged, contact us promptly so we can review the circumstances and assist with an appropriate resolution.

International orders may be subject to customs duties, import taxes, brokerage fees, or local charges. Unless otherwise stated at checkout, the recipient is responsible for these charges. International availability and shipping destinations may change.

Returns, Refunds, and Exchanges

Purchases made directly through Dloria.com are governed by our Return and Refund Policy. You must request a return within 30 days of the original order date, subject to the conditions and exclusions stated in that policy.

We do not offer direct exchanges. If you want a different item, return the eligible original item and place a separate order.

Refunds are issued to the original payment method after an approved return has been received and inspected. Your financial institution may require additional time to post the refund.

Macy's, Nordstrom, and Other Retail Partners

Purchases made through Macy's, Nordstrom, or another retail partner are transactions with that retailer and are governed by the retailer's applicable checkout, payment, shipping, return, refund, promotion, and marketplace terms.

Returns and refunds for retail-partner purchases must be requested through the retailer's customer-service department or return portal. Dloria cannot directly issue refunds for payments collected by a retail partner. Retail partners generally do not permit direct product exchanges; follow the retailer's stated return process.

Promotions, Discounts, and Gift Cards

Promotional offers are subject to their stated terms, availability, dates, and exclusions. Unless expressly stated otherwise:

Offers cannot be combined.
Discounts cannot be applied retroactively.
Promotions have no cash value.
A promotion may be limited to one use per customer or order.
Returned items may reduce or eliminate a promotional benefit if the remaining order no longer qualifies.

Gift cards are subject to any additional terms displayed when purchased or redeemed and to applicable law. Gift cards may not be redeemed for cash except where required by law.

We may modify or end a promotion where permitted by law, but changes will not affect an order already accepted under that promotion.

Product Care and Use

Jewelry should be used and cared for according to the instructions provided with the product or on the Site. Exposure to moisture, chemicals, cosmetics, cleaning products, impact, or improper storage may affect a product's finish, appearance, or longevity.

Our product descriptions and care guidance are provided for general informational purposes. They are not medical advice. If you have a known metal sensitivity, allergy, or other health concern, review the product materials and consult an appropriate healthcare professional before use.

Reviews, Photographs, and Other Submissions

If you submit a review, photograph, video, comment, suggestion, or other content ("User Content"), you represent that:

You own or have permission to submit it.
It is truthful and reflects your genuine experience.
It does not violate another person's intellectual-property, privacy, publicity, or other rights.
It is not unlawful, threatening, abusive, deceptive, defamatory, obscene, or harmful.
You received no undisclosed compensation or incentive for the submission.

You retain ownership of your User Content. By submitting it, you grant Dloria a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, distribute, and promote that content in connection with our business, products, marketing, and Services, subject to applicable law and our Privacy Policy.

We may moderate, decline to publish, or remove User Content that violates these Terms or applicable law. We are not obligated to publish every submission. Sponsored, gifted, or incentivized reviews and endorsements must include clear disclosures required by law.

Intellectual Property

The Site and its content—including the Dloria name and branding, product names, logos, designs, photographs, graphics, videos, text, page layouts, and software—are owned by or licensed to Dloria and are protected by intellectual-property laws.

We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for lawful personal shopping. You may not copy, reproduce, distribute, modify, publish, sell, exploit, scrape, frame, reverse engineer, or create derivative works from the Site or its content without our prior written permission, except as permitted by law.

Prohibited Conduct

You may not:

Use the Services for an unlawful, fraudulent, deceptive, or abusive purpose.
Submit false information or impersonate another person.
Attempt to interfere with the Site's security, operation, checkout, or payment systems.
Introduce viruses, malicious code, or other harmful technology.
Collect or track another person's personal information without authorization.
Use automated systems to scrape, copy, monitor, or extract Site content without permission.
Circumvent purchase limits, promotions, access restrictions, or security measures.
Infringe intellectual-property, privacy, publicity, or other legal rights.
Use Dloria's name, content, or products to suggest an unauthorized endorsement or affiliation.
Purchase products for unauthorized resale or export in violation of law.

Third-Party Services and Links

The Services may contain links to or integrations with third-party websites, payment services, social-media platforms, applications, or tools. Third parties operate under their own terms and privacy policies.

We are not responsible for third-party content, availability, security, products, or practices. A link or integration does not necessarily constitute our endorsement. Review the applicable third-party terms before using those services.

Privacy

Our collection and use of personal information are described in our Privacy Policy. Because Shopify hosts our store, Shopify may also collect and process personal information in connection with providing and improving its commerce services, as described in Shopify's applicable privacy notices.

Disclaimer of Warranties

To the fullest extent permitted by law, the Site and Services are provided on an "as is" and "as available" basis. We do not guarantee that the Site will always be uninterrupted, secure, timely, or error-free.

Except for any express product warranty we provide and any warranty that cannot legally be excluded, Dloria disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

Nothing in these Terms excludes or limits warranties, remedies, or consumer rights that cannot be excluded or limited under applicable law.

Limitation of Liability

To the fullest extent permitted by law, Dloria and its directors, officers, employees, affiliates, agents, contractors, suppliers, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, lost data, or loss of use, arising from or related to the Services or products.

To the fullest extent permitted by law, Dloria's total liability arising from or related to a product or transaction will not exceed the amount you paid to Dloria for the product or transaction giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited, including liability for fraud, willful misconduct, gross negligence, or personal injury to the extent applicable law prohibits limitation.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so portions of this section may not apply to you.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Dloria and its directors, officers, employees, affiliates, agents, contractors, suppliers, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Services, violation of these Terms, infringement of another person's rights, or User Content you submit.

This section does not require you to indemnify any party for its own fraud, willful misconduct, gross negligence, or other conduct for which indemnification cannot lawfully be required.

Suspension and Termination

We may suspend or terminate your access to the Services if we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or threatened the security or operation of the Services.

Provisions that by their nature should continue after termination—including provisions concerning intellectual property, User Content licenses, disclaimers, liability, indemnification, and governing law—will survive.

Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to any rights you have under the mandatory consumer laws of your state or country, disputes arising from these Terms or the Services will be brought in the state or federal courts located in San Diego County, California, and the parties consent to those courts' jurisdiction.

These Terms do not deprive you of protections that cannot be waived under the laws of your place of residence.

Changes to the Services or Terms

We may update the Services and these Terms periodically to reflect changes in our business, technology, policies, or legal obligations. The revised Terms will be posted on this page with a new "Last updated" date.

Material changes apply prospectively unless applicable law permits otherwise. Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms.

General Provisions

These Terms and the policies incorporated into them constitute the entire agreement between you and Dloria regarding the Services and supersede prior communications concerning the same subject.

If any provision is found unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of that provision. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, sale of assets, or other business transaction.

Section headings are provided for convenience and do not affect interpretation.
